1. Acceptance of Terms

By accessing our websites (oklahomamulchworks.com and okmulchworks.com), submitting a lead form, opting in to receive SMS/text messages, or engaging our services, you agree to be bound by these Terms of Service and our Privacy Policy. 3. Services Provided

Oklahoma Mulch Works LLC provides forestry mulching, land clearing, brush removal, cedar tree removal, and related services in the Oklahoma City metropolitan area and surrounding communities. All services are subject to availability, scheduling, and site conditions.

4. Quotes and Pricing

All quotes provided by Oklahoma Mulch Works LLC are estimates based on the information available at the time of the quote. Final pricing may vary based on actual site conditions, scope of work, accessibility, and other factors discovered upon arrival or during the course of the project. Any changes to the quoted price will be communicated to the customer before additional work is performed.

5. Customer Responsibilities

By engaging our services, you represent and warrant that:

• You are the legal owner of the property where services will be performed, or you have obtained written authorization from the property owner.
• You have identified and disclosed the location of any underground utilities, septic systems, wells, irrigation lines, or other buried infrastructure on the property.
• You have obtained any required permits or approvals from local authorities, including tree removal permits if applicable.
• You will provide reasonable access to the property for our equipment and personnel.
• You agree to indemnify and hold harmless Oklahoma Mulch Works LLC from any claims arising from unauthorized work, undisclosed hazards, or misrepresentation of property ownership.

6. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, check, and major credit/debit cards. For larger projects, a deposit may be required prior to the start of work. Any outstanding balance not paid within 30 days of the invoice date may be subject to a late fee of 1.5% per month.

7. SMS/Text Messaging Terms

By providing your phone number through our website, lead forms, Facebook lead ads, or any other method, and by opting in to receive text messages, you expressly consent to receive SMS/text messages from Oklahoma Mulch Works LLC at the phone number you provided. You understand and agree to the following:

• Types of Messages: You may receive messages related to appointment confirmations, scheduling reminders, quote follow-ups, service updates, and promotional offers for our forestry mulching and land clearing services.
• Message Frequency: Message frequency varies. You may receive up to 10 messages per month depending on your interactions with us.
• Message and Data Rates: Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan and any applicable charges.
• Opt-Out: You may opt out of text messages at any time by replying STOP to any message. You will receive a single confirmation message, and no further messages will be sent unless you opt in again.

• No Purchase Required: Consent to receive text messages is not required as a condition of purchasing any services. You may opt out at any time without affecting your ability to use our services.

• Carrier Disclaimer: Carriers including T-Mobile are not liable for delayed or undelivered messages.

8. Communications and Consent

By submitting a form on our website, through a Facebook or Instagram lead ad, or by contacting us directly, you consent to receive communications from Oklahoma Mulch Works LLC, including:

9. Limitation of Liability

Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim. We are not responsible for damage to underground utilities, septic systems, or other buried infrastructure that was not disclosed prior to the start of work.

10. Property and Site Conditions

Forestry mulching and land clearing involves heavy equipment operating on your property. While we take every reasonable precaution, some ground disturbance, rutting, or minor landscape impact may occur, particularly in wet or soft soil conditions. By engaging our services, you acknowledge and accept this possibility. We will make reasonable efforts to minimize any impact to your property.

11. Cancellation Policy

If you need to cancel or reschedule a confirmed appointment, please provide at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee to cover mobilization costs.

12. Weather and Force Majeure

Oklahoma Mulch Works LLC reserves the right to reschedule work due to inclement weather, unsafe site conditions, equipment failure, or other circumstances beyond our control. We will make every effort to reschedule promptly and communicate any changes to you.

13. Photographs and Marketing

Oklahoma Mulch Works LLC may take before-and-after photographs or video of our work for use in marketing, advertising, social media, and our websites. No personally identifiable information (such as your name or address) will be associated with these images without your express permission. If you do not wish for your property to be photographed, please notify us before work begins.

14. Website Use and Intellectual Property

Our websites and their content are provided "as is" for informational purposes. While we strive to keep the information accurate and up to date, we make no warranties regarding the completeness or accuracy of website content. All content on our websites, including text, images, logos, and graphics, is the property of Oklahoma Mulch Works LLC and may not be reproduced, distributed, or used without prior written permission.

15. Third-Party Platforms

Our services may involve interactions through third-party platforms including Facebook, Instagram, Google, and GoHighLevel. If negotiation is unsuccessful, disputes shall be submitted to binding arbitration in Oklahoma County, Oklahoma, in accordance with the rules of the American Arbitration Association.
